Chargie LLC, a Delaware limited liability company (“Chargie”, “we” or “us”) collects and generates information on its website located at: www.chargie.com (the “Website”) and through its related EV Mobile application (“Mobile App”) and its client platform (“Client Portal”) (collectively, the “Services”). This Online and Mobile Privacy Policy (“Privacy Policy”) covers all information collected through the Services. This Privacy Policy does not cover information collected or generated from any other website mobile application or driver portal, including those released or operated by partners and affiliates of Chargie or by any third party in connection with the Services.

Chargie’s Privacy Commitment to You
Protecting the privacy and security of the personally identifiable information and other information (collectively, “Information”) we obtain from you is important to Chargie. This Privacy Policy is designed to help you understand how we collect, generate, store, use and share your Information and help enable you to make informed decisions about the Information you disclose to us. Your Consent to this Privacy Policy
By using or accessing any of the Services, you consent to the practices described in this Privacy Policy, including any changes from any previous version of the Privacy Policy included in the current and future versions of this Privacy Policy. Your use of the Services is also subject to the Terms of Service listed on the Website, Mobile App or Client Portal.

Changes to this Privacy Policy
If Chargie makes any material changes to our practices for collecting, generating, storing, using, sharing your Information, we will update this Privacy Policy to reflect those changes. We will post the updated Privacy Policy reflecting those changes on the Website and in other places we deem appropriate. Your continued use of the Services constitutes your consent to the updated Privacy Policy. We encourage you to refer back to this Privacy Policy on an ongoing basis so that you understand our current privacy practices.

Children Under Age 13
Chargie strives to protect the online privacy of children. No part of the Services is targeted to attract anyone under 13. We will not knowingly collect or solicit personally identifiable information from or about anyone under the age of 13 without prior parental consent. We also do not send email correspondence to anyone who tells us that they are under the age of 13 without prior parental consent. We rely on parents to supervise the use of our Websites by their children. If a child under 13 has provided us with Information, please email Chargie at support@chargie.com, and we will delete the Information about the child from our files.

What Information Does Chargie Collect and Generate From You?
Chargie may ask you to provide various Information that is associated with or linkable to your name (“Personally Identifiable Information”). The Personally Identifiable Information we ask you to provide to us may include, by way of example, your name, mailing address, telephone number, mobile telephone number, driver’s license number, birth date, email address, interests, and product or service preferences. If you use a credit or debit card or pay by check for any of the Services or products, we may also collect your account number. If you opt-in to Google Analytics and Crashlytics, Device Information we collect may include information about your hardware and software, such as the hardware model, operating system version, device memory, unique application identifiers, apps installed, crash analytics, and unique device identifiers. Chargie does not collect Personally Identifiable Information through the provision of the Services unless you voluntarily provide us with that Information, however, if you choose not to provide us with certain Personally Identifiable Information, you may not be able to access all of the features included in the Services.

We may ask you to provide Personally Identifiable Information at various times and places in connection with the Services. By way of example:

  • Google Analytics
    Google Analytics is an analytics service provided by Google Inc. We use Google Analytics for Firebase, Crashlytics, Cookies as outlined elsewhere in this Privacy Policy. Users may opt-out of certain Google Analytics and Crashlytics features through the Prominent Disclosure window presented in the Mobile App or reach out to us at support@chargie.com.
  • Requests Made to Chargie
    You may be presented with the opportunity to participate in various promotional or marketing programs through the Website. If you choose to request information from Chargie or participate in one of these programs, we may ask you to provide Personally Identifiable Information.
  • Purchases Through the Website
    In connection with the Services you may be presented with the opportunity to purchase various other services or products from Chargie or one of Chargie’s affiliates. We may also ask you to provide Personally Identifiable Information when you choose to make a purchase.
  • Studies and Pilot Programs
    You may be presented with the opportunity to participate in various studies or pilot programs in connection with the Services. We may also collect and generate Information from you based on your participation a study or pilot program. If you elect to participate in a study or pilot program run by Chargie, your participation may also be subject to a separate participation agreement. Please review your participation agreement to see what additional Information Chargie may collect and generate as part of the study or pilot program.
  • Location-Based Services
    The Services may offer location-based search services to help you identify charging stations within our network. If you use these services, Chargie may collect and generate additional Information from you. This Information may include your geographic location and the other Information in connection with your search, as well as the charging stations you locate through your search. The geographic location Information may reveal your exact current location to Chargie (if, for example, you send Chargie your GPS coordinates or other precise location information). Chargie may share your location with third parties as part of these location-based services. For example, Chargie may share your location with a third party to create a map or provide directions to nearby charging stations within our network.
  • Use of Charger Stations
    If you use any charger station within our network, whether following a location-based search or otherwise, we may collect and generate Information from you regarding your use of the charger station. This Information will include, for example, the charger stations you use, the amount and type of services you obtain from each charger station, and other Information regarding your use of our services. We may associate this Information with your account with Chargie or with other Information you have provided to us. We may use this Information, for example, for use of billing you for your use of the services you obtain from each charger station.
  • Chargie Applications
    Chargie may store certain Information, including Personally Identifiable Information, on your mobile device running the Mobile App. Please consult the documentation for your mobile device and/or the website of the manufacturer of your mobile device to determine how to manage the Information stored on your mobile device.
  • Cookies and Automatic Tracking
    The Services may automatically track certain Information through the use of “cookies,” and other automatic means of tracking your use of the Services. A “cookie” is a small computer file stored by your web browser on your computer or mobile device. The cookie allows a web server to recognize your computer or mobile device when you visit the Website and collect Information regarding your usage of the Website, including the portions of the Website you click on during your visit. The cookie itself does not contain or collect any Personally Identifiable Information, but we may associate the cookie with your account with Chargie or with other Personally Identifiable Information you have provided to us. We use Information obtained through cookies and other electronic means of tracking your use of our Services primarily to improve and update the Websites, for customer service, to offer special promotions, and to collect site- traffic data. We may present this Information to third parties, but we do so only on an aggregated (i.e., non-personally identifiable) basis without identifying you or any other individual user of the Websites. If you do not wish to permit the placement of cookies on your computer, most web browsers have a feature which will allow you to block cookies. However, you should be aware that blocking the placement of cookies may disable or hinder certain Website functionalities.
  • Website Settings
    The Services may also allow you to choose to personalize certain of the aspects of the Website. When you choose to use these personalization features, Chargie may collect and store Information about your personal preferences and user settings. We may associate your preferences with your account with Chargie or with other Personally Identifiable Information you have provided to us. We may use this Information to allow personalization of the Website, to improve and update the Websites, and for customer service.

Chargie may also automatically collect certain Information from you, or generate certain information based on the Personally Identifiable Information you provide to us, that is not associated with or linkable to your name (“Non-Personally Identifiable Information”). The Non-Personally Identifiable Information we collect and generate may include, information regarding your use of the Website and the services we provide through the Website, as well as the performance of the Website and services we provide through the Website during your use. We will own all Non-Personally Identifiable Data we collect or generate and we may store, use, and share that Non-Personally Identifiable Data for any lawful purpose, provided that we maintain the Information only in the form of Non-Personally Identifiable Information and do not attempt to associate or link that Information to your name.

How Does Chargie Use The Information We Collect From You?
In addition to the purposes listed elsewhere in this Privacy Policy, we use the Information we collect or generate for various purposes, including:

  • To complete your purchase transactions
  • To provide the services or products you request
  • To identify your product and service preferences, so we can notify you of new or additional products, services, and promotions or opportunities that might be of interest to you
  • To provide you with information concerning services or products you have purchased
  • To improve our services and products, customer service, and overall user experience
  • To send you offerings by mail or email
  • To improve the product

Others With Whom Chargie May Share Your Information
Chargie may share Information that we collect with Chargie’s partners and affiliates. We may also share Information among other non-affiliated EV charging entities.

Service Providers
Chargie may disclose Information to other companies that help us bring you the products and services we offer. Chargie may work with outside companies to: (a) manage databases of customer Information; (b) assist in distributing emails; (c) to provide location, mapping, and other services through our Websites (d) assist direct marketing and data collection; (e) provide data storage; (f) provide analysis of the data; (g) provide fraud prevention, (h) provide crash reporting analytics and (i) provide other services designed to assist us in maximizing our business potential. We require these companies agree to keep confidential all Information we share with them and to use the Information only to perform their obligations in our agreement with them.

Other Companies
Chargie may provide Information to carefully selected outside companies when we believe their products or services may be of interest to you.

Sponsors
Chargie may provide Information to outside companies or entities (including government entities) that sponsor the studies or pilot programs run by Chargie pursuant to the terms under which the study or pilot program was sponsored.

Business Transitions
If Chargie, or all or a portion of our assets, are acquired by a third party, we may transfer your Information to that third party.

Compliance with Law
Chargie may be required to disclose your Information pursuant to lawful requests by law enforcement and government agencies, such as investigations, warrants, subpoenas or court orders. Chargie may also share your Information when Chargie believes it necessary to comply with applicable law, to enforce the terms and conditions applicable to the Services, or to protect our interests or our rights, property or safety or the interests, rights, property or safety of our employees, contractors, affiliates, providers, or customers.

Behavioral Advertisers
Chargie may participate in third party behavioral-based advertising. This means that we or a third party may place a cookie on your browser or use other automated means to collect Information about your use of our Website so that Chargie or the third party can provide you with advertising about products and services tailored to your interests. That advertising may appear either on our website, or on other websites. If you would like to opt-out of behavioral advertising based on your use of this website, you may do so by visiting the Network Advertising Initiative and/or the Digital Advertising Alliance.

Enhancement of Information
Chargie may combine the Information we collect and generate from you with data and information we obtain from other sources to augment, enhance, and improve the Information we collect or generate from you. If the combined Information remains Personally Identifiable Information (i.e., associated with or linkable to your name) after being combined, then we will continue to treat that Information as Personally Identifiable Information under this Policy. If the combined Information is rendered Non-Personally Identifiable Information (i.e., unable to be associated with or linked to your name) after being combined, then we may treat that information as Non-Personally Identifiable Information under this Policy.

Links to Other Sites or Applications
The Website may contain links which direct users to websites or mobile applications operated by third parties. This Privacy Policy does not apply to any other websites or mobile applications. If you choose to click on one of these links, you will be directed to the website or application operated by a third party. Any Information that you submit at these websites or applications are submitted directly by you to these third parties and will be governed by that third party’s privacy practices and procedures. Chargie is not responsible for the privacy policies or practices of these third parties.

How Can You Review Or Remove Information Chargie Collects?
You may contact Chargie at support@chargie.com if you no longer wish to be contacted by Chargie or receive promotional or marketing materials. Additionally, you may opt-out of receiving Chargie’s promotional or marketing materials by following the instructions included in each promotional or marketing communication.

  • If your Personally Identifiable Information changes, you may correct, update, delete or deactivate your Information by making the change on Chargie’s member information page, by emailing a customer service representative at support@chargie.com, or at the address and phone number listed below. Chargie will respond to your request within 10 business days.
  • You may delete your Chargie account from the Mobile App using the prompt provided. Additionally, you may delete your Chargie account by emailing a customer service representative at support@chargie.com, or at the address and phone number listed below. Chargie will respond to your request within 10 business days.
  • You can opt out of the use of cookies on the Website as described above. You cannot access or change other non-identifying Information that Chargie collects in aggregate or an automatic basis as described above.

How Does Chargie Delete Customer Information
Once you initiate deletion of your Chargie account, we end your current charging session, issue a refund of your remaining account balance, and permanently remove transaction history and any Personally Identifiable Information from our databases. The remaining account balance is refunded to the original payment method in 3-5 business days.

How Does Chargie Protect And Secure Customer Information?
Chargie has established reasonable and appropriate physical, electronic, and managerial security procedures to protect the Information we collect and store from you. Our servers are located in a secured area with cameras. We use firewalls to safeguard and protect access to our servers by unauthorized means. We follow generally accepted industry standards to protect the email addresses submitted to us, both during transmission and after receipt. We use secure servers using Secure Socket Layering (SSL) encryption when we ask you to provide us with sensitive personal Information, such as your credit card number or other financial information. Please note that secure transmission may not be used for the product pages of the Website, general Website information, or any Information transmitted through another application.

  • Despite our efforts to use reasonable and appropriate security, no security system is 100% secure and we cannot guarantee that your Information will be secure in all situations or that your Information will not be subject to loss, misuse, unauthorized disclosure, alteration, or destruction.
  • If you would prefer to provide your sensitive Information, such as a credit card number or other financial information, over the telephone, you can do so by contacting our 24 hour support at 1-800-266-0027.

Your California Privacy Rights 
Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of personal customer information we share with third parties or corporate affiliates for those third parties or corporate affiliates’ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please submit a written request to the address listed below. Please allow 30 days for a response.
