Chargie LLC, a Delaware limited liability company (“Chargie”, “we” or “us”) collects and generates information on its website located at: www.chargie.com (the “Website”) and through its related EV Mobile application (“Mobile App”) and its client platform (“Client Portal”) (collectively, the “Services”). This Online and Mobile Privacy Policy (“Privacy Policy”) covers all information collected through the Services. This Privacy Policy does not cover information collected or generated from any other website mobile application or driver portal, including those released or operated by partners and affiliates of Chargie or by any third party in connection with the Services.
Protecting the privacy and security of the personally identifiable information and other information (collectively, “Information”) we obtain from you is important to Chargie. This Privacy Policy is designed to help you understand how we collect, generate, store, use and share your Information and help enable you to make informed decisions about the Information you disclose to us. By using or accessing any of the Services, you consent to the practices described in this Privacy Policy, including any changes from any previous version of the Privacy Policy included in the current and future versions of this Privacy Policy. Your use of the Services is also subject to the Terms of Service listed on the Website, Mobile App or Client Portal.
If Chargie makes any material changes to our practices for collecting, generating, storing, using, sharing your Information, we will update this Privacy Policy to reflect those changes. We will post the updated Privacy Policy reflecting those changes on the Website and in other places we deem appropriate. Your continued use of the Services constitutes your consent to the updated Privacy Policy. We encourage you to refer back to this Privacy Policy on an ongoing basis so that you understand our current privacy practices.
Chargie strives to protect the online privacy of children. No part of the Services is targeted to attract anyone under 13. We will not knowingly collect or solicit personally identifiable information from or about anyone under the age of 13 without prior parental consent. We also do not send email correspondence to anyone who tells us that they are under the age of 13 without prior parental consent. We rely on parents to supervise the use of our Websites by their children. If a child under 13 has provided us with Information, please email Chargie at support@chargie.com, and we will delete the Information about the child from our files.
Chargie may ask you to provide various Information that is associated with or linkable to your name (“Personally Identifiable Information”). The Personally Identifiable Information we ask you to provide to us may include, by way of example, your name, mailing address, telephone number, mobile telephone number, driver’s license number, birth date, email address, interests, and product or service preferences. If you use a credit or debit card or pay by check for any of the Services or products, we may also collect your account number. If you opt-in to Google Analytics and Crashlytics, Device Information we collect may include information about your hardware and software, such as the hardware model, operating system version, device memory, unique application identifiers, apps installed, crash analytics, and unique device identifiers. Chargie does not collect Personally Identifiable Information through the provision of the Services unless you voluntarily provide us with that Information, however, if you choose not to provide us with certain Personally Identifiable Information, you may not be able to access all of the features included in the Services.
We may ask you to provide Personally Identifiable Information at various times and places in connection with the Services. By way of example:
Chargie may also automatically collect certain Information from you, or generate certain information based on the Personally Identifiable Information you provide to us, that is not associated with or linkable to your name (“Non-Personally Identifiable Information”). The Non-Personally Identifiable Information we collect and generate may include, information regarding your use of the Website and the services we provide through the Website, as well as the performance of the Website and services we provide through the Website during your use. Chargie may share Information that we collect with Chargie’s partners and affiliates. We may also share Information among other non-affiliated EV charging entities.
Chargie may disclose Information to other companies that help us bring you the products and services we offer. Chargie may work with outside companies to: (a) manage databases of customer Information; (b) assist in distributing emails; (c) to provide location, mapping, and other services through our Websites (d) assist direct marketing and data collection; (e) provide data storage; (f) provide analysis of the data; (g) provide fraud prevention, (h) provide crash reporting analytics and (i) provide other services designed to assist us in maximizing our business potential. We require these companies agree to keep confidential all Information we share with them and to use the Information only to perform their obligations in our agreement with them.
Chargie may provide Information to carefully selected outside companies when we believe their products or services may be of interest to you.
Chargie may provide Information to outside companies or entities (including government entities) that sponsor the studies or pilot programs run by Chargie pursuant to the terms under which the study or pilot program was sponsored.
If Chargie, or all or a portion of our assets, are acquired by a third party, we may transfer your Information to that third party.
Chargie may be required to disclose your Information pursuant to lawful requests by law enforcement and government agencies, such as investigations, warrants, subpoenas or court orders. Chargie may also share your Information when Chargie believes it necessary to comply with applicable law, to enforce the terms and conditions applicable to the Services, or to protect our interests or our rights, property or safety or the interests, rights, property or safety of our employees, contractors, affiliates, providers, or customers.
Chargie may participate in third party behavioral-based advertising. This means that we or a third party may place a cookie on your browser or use other automated means to collect Information about your use of our Website so that Chargie or the third party can provide you with advertising about products and services tailored to your interests. That advertising may appear either on our website, or on other websites. If you would like to opt-out of behavioral advertising based on your use of this website, you may do so by visiting the Network Advertising Initiative and/or the Digital Advertising Alliance.
Chargie may combine the Information we collect and generate from you with data and information we obtain from other sources to augment, enhance, and improve the Information we collect or generate from you. If the combined Information remains Personally Identifiable Information (i.e., associated with or linkable to your name) after being combined, then we will continue to treat that Information as Personally Identifiable Information under this Policy. If the combined Information is rendered Non-Personally Identifiable Information (i.e., unable to be associated with or linked to your name) after being combined, then we may treat that information as Non-Personally Identifiable Information under this Policy.
The Website may contain links which direct users to websites or mobile applications operated by third parties. This Privacy Policy does not apply to any other websites or mobile applications. If you choose to click on one of these links, you will be directed to the website or application operated by a third party. Any Information that you submit at these websites or applications are submitted directly by you to these third parties and will be governed by that third party’s privacy practices and procedures. Chargie is not responsible for the privacy policies or practices of these third parties.
You may contact Chargie at support@chargie.com if you no longer wish to be contacted by Chargie or receive promotional or marketing materials. Additionally, you may opt-out of receiving Chargie’s promotional or marketing materials by following the instructions included in each promotional or marketing communication.
Once you initiate deletion of your Chargie account, we end your current charging session, issue a refund of your remaining account balance, and permanently remove transaction history and any Personally Identifiable Information from our databases. The remaining account balance is refunded to the original payment method in 3-5 business days.
Chargie has established reasonable and appropriate physical, electronic, and managerial security procedures to protect the Information we collect and store from you. Our servers are located in a secured area with cameras. We use firewalls to safeguard and protect access to our servers by unauthorized means. We follow generally accepted industry standards to protect the email addresses submitted to us, both during transmission and after receipt. We use secure servers using Secure Socket Layering (SSL) encryption when we ask you to provide us with sensitive personal Information, such as your credit card number or other financial information. Please note that secure transmission may not be used for the product pages of the Website, general Website information, or any Information transmitted through another application.
Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of personal customer information we share with third parties or corporate affiliates for those third parties or corporate affiliates’ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses.
